SEC Seeks Confirmation from Technology Crime Division on Ben Smith Case

Bangkok: The Securities and Exchange Commission (SEC) has reached out to the Technology Crime Suppression Division (TCSD) to verify details concerning the case of Ben Smith. The SEC has also requested assistance from the Economic Crime Suppression Division (ECD) in response to a letter submitted by Thanadol Suwannarit, legal representative for Mr. Ben Smith, urging the SEC to investigate and clarify whether Mr. Benjamin Berger, the individual accused by the SEC, is the same person as Mr. Benjamin Mauerberger or Mr. Ben Smith. According to Thai News Agency, Deputy Secretary-General and SEC Spokesperson Mr. Anek Yoo-yuen confirmed receipt of the letter from Mr. Thanadol. The SEC has been asked to clarify the identity of Mr. Benjamin Berger and whether he is indeed the same person as Mr. Benjamin Mauerberger or Mr. Ben Smith. The SEC has been approached by various agencies and individuals regarding this matter. The SEC has previously filed a complaint with the ECD against Mr. Benjamin Berger in 2021 for offeri ng securities without a license in 2019. Alongside the complaint, the SEC submitted information to verify Mr. Benjamin Berger's identity. However, the SEC currently lacks information to confirm if Mr. Benjamin Berger, Mr. Benjamin Mauerberger, or Mr. Ben Smith are linked. Consequently, the SEC has enlisted the help of the ECD to ascertain the identities of the accused individuals, which will aid in pursuing legal actions. Rangsiman Rome, a member of the Prachachon Party, previously disclosed that in 2019, Ben Smith, also known as Benjamin Mauerberger, was involved in unauthorized securities fundraising. The SEC filed charges in 2021 under the Securities and Exchange Act. The public prosecutor is presently considering whether to proceed with an indictment. Relevant laws for prosecution include the Digital Asset Business Act, the Anti-Money Laundering Act B.E. 2562, and the Cybersecurity Act B.E. 2566.
