Attorney Confirms Complete Testimony Submission to DSI in Icon Pyramid Scheme Case.


Bangkok: “Attorney Witthayu” has confirmed that the testimonies of “Boss Paul-B. The Icon” have been fully submitted to the Department of Special Investigation (DSI). “Boss Paul” remains puzzled about “Samart’s” imprisonment and confirmed that he has not met “Lawyer Tum” due to the prison’s separation policy.

According to Thai News Agency, Mr. Witoon Kaengngan, the lawyer representing Boss Paul, disclosed after a visit to his client that the testimonies from Boss Paul and The Icon Group Company Limited have been submitted concerning special case no. 119/2567. This case involves criminal charges against The Icon Group Company Limited and their associates, suspected of operating a pyramid scheme. The defense testimony challenges the charges filed by the DSI under the Emergency Decree on Fraudulent Borrowing of Money from the People B.E. 2527. It clarifies the concept of “Dealer gets dealer,” arguing that it pertains to a one-time brokerage fee rather than a recurring monthly payment as alleged. Supporting docu
ments, identical to those provided to the National Anti-Corruption Commission (NACC), were included in the submission.

Mr. Witoon further explained the defense against allegations related to the Direct Sales and Direct Marketing Act of 2002. He compared the case to a Supreme Court ruling involving a direct sales business to argue that The Icon Group’s operations do not constitute network creation as defined in Section 19 of the Direct Sales Act.

Regarding accusations of operating a direct sales business without permission, Mr. Witoon stated that evidence from the Consumer Protection Board supports that The Icon Group is classified as a direct market. This classification is backed by order 4/2565 from the Consumer Protection Board, which was included in the documents submitted to the DSI. Other suspects, including Boss, reportedly confirmed similar statements to those made by Boss Paul.

Mr. Witoon also addressed the submission of over 2,000 witness testimonies to the DSI, aiming to prove the innocence of th
e accused. Initially, around 500 testimonies were submitted, with an additional 100 provided recently. Adjustments were made to the testimony format, with representatives being sent to the DSI instead of individual witnesses. Mr. Witoon sent 30 representatives, while questioning of witnesses continues.

In relation to a sum of 1.9 million baht, Mr. Witoon mentioned that he had not yet inquired with Boss Paul about its transfer. The request for temporary bail for Boss Win, who is suffering from leukemia, is pending documentation from prison doctors. Mr. Witoon also updated Boss Paul about Mr. Samart’s incarceration in the Bangkok Special Prison. Boss Paul expressed curiosity about the charges against Mr. Samart but did not comment further, confirming that he had not met Lawyer Tum due to prison separation protocols.
